Judge denies immunity for defendant in Loris shooting

A significant legal hurdle has been cleared in the prosecution of a 22-year old man charged in connection with a deadly 2024 shooting that rocked the Loris community.

Tre’Shawn Davis, who faces murder charges for the death of Mic’Kell Grissett, 19, was recently denied immunity during a stand-your-ground hearing in Horry County.

The incident, which took place in January 2024 on Cheryl Road, centered on a violent confrontation involving a large crowd, during what investigators described as a pre-arranged fight advertised on social media.

While Davis and his legal counsel argued that he acted out of fear for his life and was backing away from perceived attackers when shots were fired, the state successfully argued that the defendant and his girlfriend were active participants who voluntarily entered a volatile situation they knew was brewing.

The presiding judge agreed with the prosecution’s assessment that the defendant was not an innocent bystander caught in an unexpected ambush.

Evidence presented during the hearing suggested that the fight had been widely discussed online and that Davis had armed himself before arriving at the scene. Video footage played in court showed Davis retreating just before the gunfire erupted, but the court ruled that his prior knowledge of the altercation and his decision to join the fray negated his claim for self-defense immunity.

As the case moves forward, Davis remains facing additional charges of attempted murder and possession of a weapon during a violent crime. The outcome of the hearing underscores the high legal bar required for stand-your-ground immunity in cases where a defendant is found to have prior knowledge of a conflict.
